The Planning Board approved a site plan for Adrian Auto Body in 2000, but at that time the inspections necessary to get a CO were not done.  Now Mr. Adrian is refinancing his property and his bank is holding a significant amount of money in escrow, pending the resolution of the CO issue.  Mr. Tegeder and Town Engineer Sharon Robinson have recently inspected the property and noticed deviations from the approved site plan.  Among others, these deviations include the construction of a berm where there should be a fence and the location of the dumpster pad.  At the suggestion of Mr. Tegeder, Mr. Wright is asking the Planning Board if the deviations from the site plan are minor or substantial enough to require a new site plan review.  The Planning Board will perform a site visit and discuss the issue at the next work session.

Request for Certificate of Occupancy
This was a follow-up discussion as to whether the deviations on this site from the approved site permit are substantial enough to require an amended site plan or insubstantial.  The issue arose when Mr. Adrian realized, when he applied for refinancing, that final inspections were not done and he did not have a valid CO for the property.
 
The deviations include:
A berm where the site plan calls for a fence
The berm is actually taller than the required fence.  Since the function of the fence was to screen the property from view from Route 202, the Planning Board decided the berm would be sufficient.  However, the berm is not actually on the property under discussion, so language will be developed indicating Mr. Adrian's responsibility to construct the fence should the current owners of the berm decide to remove it.
 
Missing Landscaping
Mr. Adrian said the property had been landscaped as per the site plan until last fall when the plantings were removed to install an underground sprinkler system.  The landscaping was not replaced at that time because it was at the end of the growing/planting season.  He intends to re-landscape at this time.  The Planning Board accepted that.
 
Propane tank and dumpster locations
These will be moved to conform to the original site plan.
 
Additionally, Mr. Flynn had concerns about a plastic canopy attached to the outside of a building on the site which is not shown on any site plans.  He called it an accessory structure which needs approval to exist there and questioned whether the plastic canopy was an appropriate material to use in an area where auto repair and painting was done.  He thought it might be a fire hazard.  Mr. Adrian said the canopy was meant to be temporary and could be removed if that's what the Planning Board directed.  The Planning Board directed Mr. Adrian to ask the Building Department for its opinion about whether this canopy is an accessory structure and about the fire safety issues and to provide the Planning Board with a letter from the Building Department.
 
In summary,
1.  Mr. Adrian will provide site plan drawings showing the required and agreed upon changes discussed at this meeting
2.  the Planning Board will provide a memo indicating this submission represents the  latest site plan
3.  Mr. Adrian will bond the relocation of the propane tank and dumpster
4.  a new survey will be done
5.  the Planning Board will sign the revised site plan
6.  Mr. Adrian will get his CO   
 


July 13, 2009, work session
Mr. Adrian submitted a revised site plan in response to the board's earlier comments. As the board said it was satisfied with the changes, the Planning Department will send a memo to the Building Department stating that the site plan is acceptable, thereby paving the way for the Building Department to issue the needed certificate of occupancy.

Discussion Amended Site Plan
Description: Proposed additions and additional parking to the rear of the existing building.
 
Mr. Adrian described a proposed 3000 sq. ft. L-shaped addition to his existing building, which would house work space for disassembling and reassembling cars.  Parking would be moved from behind the building to the side and would cover an area 40’x125’.  The new  parking area would not be visible from Old Crompond Rd or from neighboring residences.   There is a wetland buffer in this area, but the parking would be kept at least 73 ft away.  The wetland itself is on the adjacent property.  Less than 5000sq ft of bank run would be removed for the parking area, which is below the threshold for an excavation permit.  There was some discussion of the proposed location of the propane tanks.  Ms Kutter asked about venting of paint fumes.  There will be no increase in the amount of painting done and therefore no changes in the venting situation.  Ms. Kutter also asked about the poor site distance upon exiting the property.  Mr. Adrian maintained the dangerous situation was caused by motorists speeding along Old Crompond Rd as they use it to avoid traffic on Route 202, a situation over which he has no control.  There was some discussion of making one of the site’s driveways one-way, but the consensus was that this wouldn’t accomplish much.   The Planning Board generally approved of the project and instructed the applicant to meet with the Planning Department in order to make a formal application.
