Certificate of Appropriateness/Congregational Parsonage, Granite Springs Road

Because his house, the former Congregational Parsonage on Granite Springs Road was designated landmark in 1976 and needs new siding, homeowner Jay Kaplan was before the board to request the required Certificate of Appropriateness that is needed before he can make the improvement.

While the board and Nancy Milanese representing the Advisory Board on Architecture & Community Appearance (ABACA) had no problem with Mr. Kaplan's choice of replacement siding, the board is faced with the following procedural problem: The town's Landmarks Law requires the town's Landmarks Commission to issue all Certificates of Appropriateness. However, as the Commission currently has only one member, it cannot technically vote. So the issue is whether or not the town board could, under certain circumstances, issue the Certificate. The board requested Town Attorney John Buckley to look into the matter and determine whether the board could issue the Certificate as a special act on a one time basis given the special circumstances. Councilman Metz noted that the homeowner needed to “get going” on the project.
