Description: Proposed 2-lot subdivision on 11 acres in the R1-80 zone.

April 7, 2008
Mr. Giordano recused himself from this discussion. This project has been before the Planning Board previously and had a public hearing May 21, 2007, but the Planning Board passed no resolutions on it. The property has new owners and the project a new engineer. Mr. Cicarcia wanted to “reintroduce the board to the project”, but really didn't have any specific information. According to Mr. Cicarcia, the plans was basically the same with some slight changes to the houses. Everyone's memory of the project was very vague. Apparently Bruce Barber had some concerns about a “critter crossing.” Mr. Cicarcia is going to check with him, and the Planning Department will resurrect the Planning Board files on the project.

Mr. Giordano recused himself on this application.

Mr. Ciarcia has a whole list of concerns from the Conservation Board and the Town Engineer.  He said that most of them are minor and had been addressed in the most recent plans, but he would meet with the Town Engineer to work out those concerns still outstanding.  Mr. Ciarcia was under the impression that the project had already had a public hearing under its previous owner and engineer, but Ms. Crispi said that was only an informational meeting and that a public hearing was still required.

Mr. Ciarcia asked if the public hearing could be on July 14th, if required, assuming that he worked out the remaining concerns with the Town Engineer.  The Board agreed to that.  Attorney Wagner pointed out that a conservation easement needs to be shown on the plans and questioned the status of the project's road.  The Planning Board said that the road will be private, but that the Town wants a right of way.  Also the wetlands and AT&T easement need to be shown on the plans.

SEQRA Determination

This subdivision, which had been before the Planning Board as a three lot subdivision, is being reactivated as a two lot subdivision.  The Planning Board declared itself the lead agency under SEQR.

Dan Cicarcia, the engineer for this project, gave the Planning Board an update on his progress in meeting the requirements the Engineering Department had laid out.  The Planning Board had been reluctant to move toward passing an approval resolution because of these outstanding issues.  Mr. Cicarcia was hopeful that the project would be approved soon since most of the requirements have been addressed.


February 9, 2009, work session
Dan Ciarcia, the applicant's engineer told the board that the applicant wanted to move forward on the subdivision plan which has been pending for over two years. He said that a list of concerns from the town engineer had been vittled down, and that a new SEQRA public hearing would have to be held. He will review the project's file to determine when the site's wetlands were originally flagged so that the board can determine whether they will have to be reflagged. The Conservation Board reported that it had no issues to comment on at this time. The application may be on the board's March agenda.

March 9, 2009
The board opened and closed a SEQRA public hearing without any public comment. The DEP and DEC are reviewing the stormwater plans for the project.

July 13, 2009, work session
The board agreed that if everything was ready, the application would be scheduled for a public hearing on August 10th.

August 10, 2009
After Mr. Giordano recused himself, the Planning Board did not have a quorum so a vote could not be taken.  
 
September 14, 2009
The board declared itself the lead agency for SEQAR purposes and issued a negative declaration based on the long form EAF submission. The board then approved the decision statement for the 2 lot subdivision which was based on the prior plan.
